Expiation in the Holy Quran Comparative juristic study

جاءت الشريعة الإسلامية خاتمة الشرائع الإلهية السابقة وناسخة لها ، لذا فقد ضمن الله لها البقاء فحفظها من كل تحريف ، وأكملها وصانها من كل نقص ، وأتمها على عباده المؤمنين ، ورضيها حاكمة بين الخلق في كل صغير وكبير وحقير وقطمير، قال الله تعالى {إِنَّا نَحْنُ نزلْنَا الذِّكْرَ وَإِنَّا لَهُ لَحَافِظُونَ} [سورة الحجر: 9] ، وقال { الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الإسْلامَ دِينًا} [سورة المائدة : 3] ، وقال {مَا فَرَّطْنَا فِي الْكِتَابِ مِنْ شَيْءٍ ثُمَّ إِلَى رَبِّهِمْ يُحْشَرُونَ} [سورة الأنعام : 38] ، ومن هذا الحفظ والإتمام والرضا أن شرع الله لعباده الكفارات لمن أخطأ في دنياه بارتكاب محظور أو بالتهاون في مأمور ، فجاء تشريع الكفارات في القرآن والسنة وإجماع الأمة ، وذلك لتكون تأديبا لمن أخطأ ، وزجرا له وللناس عن الفعل المذموم ، وأيضا لتكون تكفيرا لذنبه ، وليعتريها أمرا متعديا وهو استفادة المحتاج من المسلمين كعتق رقبة مؤمنة أو إطعام نفر من المساكين أو كسوتهم أو صيام أيام أو أشهر لتهذيب نفس المذنب .. . ولأهمية هذا الباب وهو الكفارات ، ولحاجة الناس الشديدة إليه كانت كتابة هذا البحث ، بعنوان (الكفارات في آيات القرآن الكريم دراسة فقهية مقارنة) وحاولت فيه تبيين أنواع الكفارات في القرآن وفقهها من خلال آيات القرآن والكتب الكاشفة لمعانيه ، ومن خلال كتب الفقهاء والأئمة المعتبرين كالأئمة الأربعة وغيرهم ممن كان على نهج أهل السنة والجماعة وشهد له القاصي والداني بذلك . وفيما يتعلق بموضوع هذا البحث (الكفارات في آيات القرآن الكريم دراسة فقهية مقارنة) لقد عمدت هذه الدراسة إلى تتبع الكفارات وبيانها ، وتسليط الأضواء الكاشفة عليها من خلال تلمسها في الآيات القرآنية ، بهدف إبراز محاسن التشريع ، وبيان أسراره وحكمه ، وذلك تصويرا لواقع الكفارات ، وبيانا لأهميتها في حياة الفرد المسلم ، حيث تكتسب أهميتها العظيمة من الكتاب ، والسنة ، والإجماع .

Because of the importance of this chapter, which is atonement, and for the people’s great need for it, this research was written under the title (Expirations in the verses of the Holy Qur’an, a comparative juristic study) in which I tried to show the types of expiation in the Qur’an and its jurisprudence through the verses of the Qur’an and books revealing its meanings, and through the books of jurists and imams considered as the four imams And others who were following the approach of Ahl al-Sunnah wal Jama’ah, and far and near witnessed this. With regard to the subject of this research (Expiation in the verses of the Holy Qur’an, a comparative juristic study), this study has traced the expiation and its manifestation, and the spotlight is revealed on it through its touching in the Quranic verses, with a view to highlighting the merits of legislation, and clarifying its secrets and wisdom, in order to illustrate the reality of the infidels, and a statement For its importance in the life of the Muslim individual, where it gains its great importance from the book, Sunnah, and consensus.
