تعد حقوق السحب الخاصة نظاماً مبتكراً ابتدعه صندوق النقد الدولي لحل مشكلة نقص السيولة التي واجهت الجماعة الدولية في أواخر ستينيات القرن العشرين. و على الرغم من الانقسامات الدولية حول إدخال نظام حقوق السحب الخاصة في صلب النظام النقدي الدولي، و الطبيعة القانونية لهذه الحقوق، و الدور الذي ينبغي أن تأخذه، و الحجم الذي ستكون عليه، انطلق هذا النظام مع التعديل الأول لاتفاقية صندوق النقد الدولي عام 1969. و قد أنتجت ثلاثة إصدارات من حقوق السحب الخاصة كان آخرها و أكبرها حجماً ما مقداره 161.2 مليار وحدة، بما يعادل 250 مليار دولار أمريكي لتضاف إلى إصدارات سابقة أقل كثيراً. يعالج هذه المقال موضوع حقوق السحب الخاصة من خلال عدد من النقاط: تتناول النقطة الأولى مفهوم حقوق السحب الخاصة و أصول نشأتها؛ و تركز الثانية على طبيعتها القانونية، و شروط استخدامها، و كيفيته، و التزامات مستخدميها؛ و تعالج الثالثة آلية تخصيصها؛ و تبين الرابعة واقع حقوق السحب الخاصة، و الفرق بين نظامها و بين النظام المعتمد على الدولار؛ فيما تبحث الخامسة في إصلاح نظام حقوق السحب الخاصة، و تقدم تصورات محتملة لدورها المستقبلي.
The Special Drawing Rights (SDR) is an innovative system made by the International Monetary Fund. It was coined to resolve the problem of the lack of liquidity that faced by the international community in the late sixties of the twentieth century. The system of SDR was executed with the First Amendment to the Agreement of the International Monetary Fund in 1969, although of the International dispute regarding many topics, Such as the enclosure of SDR as a key component inside the international monetary system, the legal nature of SDR, and the size and the role that it should take. Three versions of the SDRs have been produced. The latest and largest one was 161.2 billion units, which is equivalent to 250 billion USD, to be added to the earlier smaller versions. This study addresses the SDR through few points: The first one deals with the concept of SDR and the origin of its inception. The second focuses on its legal nature, and obligations of its users. The third point deals with the mechanism of the allocation of SDR. The fourth addresses the reality of the SDR, and the difference between its system and the system which is based on the dollar. The fifth and last point looks at amending the SDR system, and providing possible scenarios for its future role. ...

The rights and freedoms have even turned into one of the important measures for growth, and consequently, international concern for human rights has become one of the main distinguishing features of the contemporary international system.
تناولت الدراسة موضوع الآليات الدولية وال شرعية الخاصة بحماية حقوق المرأة في ظل العولمة، وهو من الموضوعات التي ثار الجدل فيها حول وضع المرأة في المجتمعات على مدى العصور، بحيث تأثر وضع المرأة باختلاف الزاوية التي ين ظر بها إليها بالنسبة لتقيـيم جهودهـا
وتقدير دورها وثقلها، باختلاف الأزمنة والأمكنة و التطور الفكري والع لمي. مما أدى إلى العمـل على وضع الآليات باختلاف أنواعها حتى تعمل على تفعيل مبدأ المساواة وعـدم التمييـز ضـد المرأة في كافة مجالات الحياة. إن الاهتمام بحماية حقوق المرأة تجلى منذ زمن طويل، وقد تمخضت عنه إيجابيـات لا يمكن إغفالها، من أهمها إصدار كافة الدول على اختلاف مستوياتها العديد من القوانين الوطنيـة التي تعنى بحماية حقوق المرأة، وأيضاً توقيع الاتفاقيات وإصدار الإعلانات و عقـد المـؤتمرات التي تمنع التمييز ضد ال مرأة، وأخيراً تفعيل هذه الحقوق عن طريق الرقابة والإشراف من خلال التطبيق الفعلي لها على أرض الواقع. وقد تم تقسيم الدراسة إلى خمسة فصول، بين ت في الفصل الأول الإطار العام للموضوع، وفي الفصل الثاني بينت الدراسة مفهوم حقوق المرأة في القـانون والمعاهـدات، ثـم التطـور التاريخي لنشأة هذه الحقوق، أما الفصل الثالث فقد خصص لبيان مكانـة وحقـوق المـرأة فـي ك الشريعة الإسلامية، أما فيما يتعلق بالآليات المباشرة وغير المباشرة الدولية والإقليمية والشرعية والوطنية، والحكومية، وغير الحكومية في عصر العولمة، فقد حظيت باهتمام الفصل الرابع. وقد خرجت الدراسة من خلال الفصل الخامس بعدد من النتائج والتوصيات أهمهـا، أن الشريعة الإسلامية هي السباقة التي اهتمت بحماية حقوق المرأة منذ أكثر من أربعة عشر قرنـاً، حيث أعلت من مكانة المرأة، وشرعت لها من الحقوق التي تق وم علـى أسـاس المـساواة مـع الرجل، ومنعت التمييز ضدها، ووضعت كافة التدابير التي تقوم علـى حمايـة هـذه الحقـوق، ومعاقبة من ينتهكها عن طريق القضاء، أما بالنسبة للمجتمع الوطني والإقليمي والـدولي، فهـو اللاحق في سن هذه الحقوق للمرأة، والاهتمام بتفعيلها بكافة الآليات الم توفرة على كلا الصعيدين المباشر وغير المباشر. ومن أهم التوص يات لهذه الدراسة ضرورة إقامة جهاز دولي، تكـون حقـوق الإنـسان والمرأة مضمونة فيه، وقائم على نتاج متخصصين في الشرع الإسلامي والدولي معـاً، وتـستند إلى إطار قانوني شامل وملائم ومتكامل أيضاً، لحقوق الإنسان والمرأة. كما توصي الدراسة بالحاجة إلى معايير حديثة وثابتة بالنسبة لحقوق الإنسان أو حقـوق المرأة، بحيث يحكم الإطار القانوني تلك الحقوق، وأيضاً يحكم الآليات المقامـة لإ عمـال تلـك النصوص أو تنفيذ تلك الآليات إن وجدت طبعاً، والعمل الجاد على إنشائها إن لم تكن موجودة.
