IN this research,I have First defined many issues, then I have tried to explain globalization being the out come of a self power , including its continuation. I have also shed light on the comprehensive side of globalization through the complex inter relation among human Beings on the cultural , individual , institutional and social level. I have tried to focus on two main points. First, Globalization is an attempt to gather the world states and their different regions in one entity , This is known as a small village. Second, I have focused on the dimensions of globalization and our awarcness of it , because this movement makes us engaged in one state , called "the global society" .

تنطلق فكرة هذه الأطروحة بموضوعاتها المختلفة من مشكلات يعاني منها القانون الدولي العام تتجسد بالآتي :
1) الواقع المعاصر لمنظومة القانون الدولي العام وما يتعرض له من انتقادات وتشكيك في جدواه وخاصة في العقدين الأخيرين.
2) إسناد الثغرات التي يبديها أد
اء القانون الدولي العام إلى اختلال جسيم في قواعده وضعف فعالية آلياته ، دون ملاحظة حدة التحولات التي باتت تفرض نفسها على جميع مناحي الحياة البشرية بما فيها العلاقات الدولية ، الأمر الذي انعكس بدوره على أداء القانون الدولي العام وفضاءاته التي يتحرك فيها ، دونما أن تحظى قواعده بأي فرصة لمراجعة جادة أو تعديل جوهري لمسايرة هذا الواقع الجديد .
3) طرح توجه جديد لدراسة وتحليل أداء القانون الدولي العام بفروعه المختلفة انطلاقاً من فهم حقيقي وعميق لواقعه المعاصر ، فهم يلحظ التحولات الحادة التي باتت تشهدها الساحة الدولية ، وخاصة بعدما شهده العالم من ثورة هائلة في تقنيات وسائل الاتصال ونقل المعلومات ، تعززت معها ظاهرة قديمة متجددة هي ظاهرة العولمة التي باتت تشكل عصب الحركة الرئيس لمختلف مناحي النشاط البشري السياسية والاقتصادية والاجتماعية والثقافية والعسكرية ، وأصبحت تفرض بتداعياتها على تلك الميادين واقعاً دولياً جديداً يختلف بشكل جذري عن ذلك الواقع الذي كان يعيشه العالم في النصف الثاني من القرن العشرين ، ونجاح مثل هذا الطرح سيعطي القانون الدولي فرصة لمراجعة جادة سواء فيما يتصل ببنيانه الموضوعي أم التنظيمي ، وبما يكفل تحسين أدائه واستدراك الثغرات التي يبديها تطبيقه مستقبلاً في مختلف ميادين العلاقات الدولية .
The research aims to solve one of the most complex issues of sociology of
development and social change, not to mention the dismantling of one of the most
important issues of sociology and sociology of culture. The issue of capitalist globalization

relationship between diverse knowledge in its formation. The research will

The reflection of the reality of the Arab world in the present age makes us discover

colonial countries, they still suffer from intellectual colonization, which led to divisions
and fighting and violence in their societies, which led to its cultural and intellectual
invasion by Western society.
I spoke about the culture, its concept and its role in society and its importance to the
people in general and young people in particular and how they became the subject of

the impact of globalization on the fragmentation of cultural identity. Then I spoke about

تناولت الدراسة موضوع الآليات الدولية وال شرعية الخاصة بحماية حقوق المرأة في ظل العولمة، وهو من الموضوعات التي ثار الجدل فيها حول وضع المرأة في المجتمعات على مدى العصور، بحيث تأثر وضع المرأة باختلاف الزاوية التي ين ظر بها إليها بالنسبة لتقيـيم جهودهـا
وتقدير دورها وثقلها، باختلاف الأزمنة والأمكنة و التطور الفكري والع لمي. مما أدى إلى العمـل على وضع الآليات باختلاف أنواعها حتى تعمل على تفعيل مبدأ المساواة وعـدم التمييـز ضـد المرأة في كافة مجالات الحياة. إن الاهتمام بحماية حقوق المرأة تجلى منذ زمن طويل، وقد تمخضت عنه إيجابيـات لا يمكن إغفالها، من أهمها إصدار كافة الدول على اختلاف مستوياتها العديد من القوانين الوطنيـة التي تعنى بحماية حقوق المرأة، وأيضاً توقيع الاتفاقيات وإصدار الإعلانات و عقـد المـؤتمرات التي تمنع التمييز ضد ال مرأة، وأخيراً تفعيل هذه الحقوق عن طريق الرقابة والإشراف من خلال التطبيق الفعلي لها على أرض الواقع. وقد تم تقسيم الدراسة إلى خمسة فصول، بين ت في الفصل الأول الإطار العام للموضوع، وفي الفصل الثاني بينت الدراسة مفهوم حقوق المرأة في القـانون والمعاهـدات، ثـم التطـور التاريخي لنشأة هذه الحقوق، أما الفصل الثالث فقد خصص لبيان مكانـة وحقـوق المـرأة فـي ك الشريعة الإسلامية، أما فيما يتعلق بالآليات المباشرة وغير المباشرة الدولية والإقليمية والشرعية والوطنية، والحكومية، وغير الحكومية في عصر العولمة، فقد حظيت باهتمام الفصل الرابع. وقد خرجت الدراسة من خلال الفصل الخامس بعدد من النتائج والتوصيات أهمهـا، أن الشريعة الإسلامية هي السباقة التي اهتمت بحماية حقوق المرأة منذ أكثر من أربعة عشر قرنـاً، حيث أعلت من مكانة المرأة، وشرعت لها من الحقوق التي تق وم علـى أسـاس المـساواة مـع الرجل، ومنعت التمييز ضدها، ووضعت كافة التدابير التي تقوم علـى حمايـة هـذه الحقـوق، ومعاقبة من ينتهكها عن طريق القضاء، أما بالنسبة للمجتمع الوطني والإقليمي والـدولي، فهـو اللاحق في سن هذه الحقوق للمرأة، والاهتمام بتفعيلها بكافة الآليات الم توفرة على كلا الصعيدين المباشر وغير المباشر. ومن أهم التوص يات لهذه الدراسة ضرورة إقامة جهاز دولي، تكـون حقـوق الإنـسان والمرأة مضمونة فيه، وقائم على نتاج متخصصين في الشرع الإسلامي والدولي معـاً، وتـستند إلى إطار قانوني شامل وملائم ومتكامل أيضاً، لحقوق الإنسان والمرأة. كما توصي الدراسة بالحاجة إلى معايير حديثة وثابتة بالنسبة لحقوق الإنسان أو حقـوق المرأة، بحيث يحكم الإطار القانوني تلك الحقوق، وأيضاً يحكم الآليات المقامـة لإ عمـال تلـك النصوص أو تنفيذ تلك الآليات إن وجدت طبعاً، والعمل الجاد على إنشائها إن لم تكن موجودة.
