The President in the Syrian constitutional system and the French
one has specialties and, and according to the principle witch says:
there must be balance between the given power to the President and
his responsibility, so there is no power and au
thority without
responsibility, and there is no existence of responsibility if the
power does not exist.

, the researcher has pointed in this research to the kind <<President
of the president responsibility in each of the Syrian and French
constitutional system.
The aim of this study is conducting a comparison between the internal law of the
Syrian basic education schools and the corresponding law in French schools in order to
determine the extent to which each law is consisting with total quality manageme
nt
principles, so as to benefiting from French experience in this field. To achieve this aim, a
comparative approach is adopted. The results showed that the Syrian internal law has not
been designed according to the total quality management principles intentionally, where it
focused on some principles and ignored others. For example, it focused on matching
student's need as beneficiary, but ignored both graduate's need for work and marketplace
itself as beneficiary. In addition, the internal law did not give sufficient importance to
supporting top management principle to achieve quality. In contrary, the corresponding
French law focuses on the total quality management principles intentionally. Despite not
having exactly the same names as mission, the vision and quality councils, even though
they are incorporated in the content. It is suggested that there is a need to benefit from
strength points in the French law taking into account the Syrian conditions.
The trend of taking the dual judiciary system and the emergence of the administrative
judiciary ، specialist to look at the administrative disputes، did not prevent the normal
judiciary to exercise its role in the protection and preservation of the
principle of legality
and its control over the illegal resolutions and such limited control over the control of
abstinence preclude the contribution of the normal judiciary in the application of illegal
text ، and the late application of the legal text and justice .
منذ قرار محكمة المنازعات الفرنسية "بلانكو"، سقط مبدأ عدم مسؤولية الدولة عن أعمال القائمين على المرافق العامة، ليحل محله مبدأ مسؤولية الدولة. بيد أن هذه المسؤولية لم تصل إلى مرفق القضاء تحت ذرائع أو حجج ذات طبيعة عملية، و أخرى ذات طبيعة قانونية.
و بف
ضل تدخل المشرع، منذ بدايات القرن الماضي، أصبحت مسؤولية الدولة عن مرفق القضاء مبدأً مقررًا، و لو على نحو خجول أو محدود. و لكن إعمال هذه المسؤولية بقي مقيدًا بارتكاب القاضي "خطأً جسيمًا"، و إن كان تطبيق مفهوم "الخطأ الجسيم" كأساس للمسؤولية نادرًا أمام القضاء العدلي، و مستحيلا أمام القضاء الإداري.
و بفضل التحولات العميقة في مفهوم دولة القانون من خلال دمقرطة عمل المرافق العامة، و ظهور مفاهيم الحكم الصالح، الذي يستند إلى تعزيز المساءلة في العمل العام، و تحديد معايير واضحة لمفهوم العدالة، و لاسيما فكرة "المحاكمة العادلة". و كذلك بتأثير توجهات القانون الأوربي (الاتفاقية
الأوربية لحقوق الإنسان، و قرارات المحكمة الأوربية لحقوق الإنسان)، تم التوسع في إعمال مسؤولية الدولة عن أعمال القاضي، ول اسيما القاضي الإداري، بسبب تأخره في البت في المنازعات المطروحة أمامه في "مدة معقولة".
هذا الأمر عزز - بلا شك - مفهوم دولة القانون، و هو ما دعانا إلى التساؤل عن إمكانية إعمال هذا المفهوم أمام المحاكم في الدول العربية، و لاسيما بعد استفحال ظاهرة التأخير في البت في المنازعات القضائية في معظم الدول العربية.
