إن نشوء الدين يمكن أن يهددالدائن بخطر إعسار مدينه لذا فقد وضع القانون المدني السوري في تصرف الدائن جملة من الوسائل القانونية الهادفة إلى المحافظة على الذمة المالية لمدينه توصلا إلى حماية حقه في الضمان العام.

فيما بينهم على رفع الأسعار، فيكون سعر السلعة في السوق مفتعلا لا طبيعيًا، فعندها يمكن
للحاكم أن يتدخل، فيحدث التوازن في الأسعار و ذلك بخفض السعر المفتعل إلى السعر الطبيعي أو
ما يسمى بثمن المثل.
غير أن تدخل الحاكم في تسعير السلع أمر مختلف فيه بين الفقهاء، فاقتضى الأمر بحث المسألة
على طريقة الفقه المقارن، لإعطاء تصور واضح و مختصر في هذه المسالة، و ذلك لإبراز دور
الفقهاء في مسائل الاقتصاد الإسلامي.
